Permitting – both sites

Good afternoon Mr. Cabiness,

As a follow-up to our recent phone conversation, I wanted to provide to you the information that I received from the Houston Permitting Center regarding your question from this morning:

Yes, a permit is required and yes, the permit has been issued.  (See Attached)

RE: 19142051 – 15635 ½ Memorial Dr. 7075 = Sitework & Utilities.  This project was approved and permits purchased on 07/14/2022.  Reviewed and Approved by the following departments:  Structural, Flood, City Planning, Plumbing, Storm Drainage, Water and Traffic.

RE: 22042858 – 15635 Memorial Dr. Building 4 77079 = New Multifamily Development w/Parking Garage. (Master of 10) This project has NOT yet been approved and currently in the review phase.  Departments involved in the review are Flood, Storm Drainage, Electrical, Fire Marshal, Hvac, City Planning, Plumbing, Traffic and Water Department. 

All projects will and shall comply with ALL applicable City Ordinances and Building Codes.  I am certain no approvals were granted or will be granted nor a permit issued before complete compliance is achieved.  I have looped in City Engineer Mr. Suhail Kanwar PE in case there are any follow questions pertaining to the Traffic, Storm, or Flood reviews. “

My GC pal read all the information on our website and is equally shocked by these developments and does not think the existing infrastructure can handle these two developments (whatever that is worth).  He can’t believe that they have already passed Commercial/site works/utilities review, see first snippet below.  Flood plain?  Storm drain?  These should be challengeable.  He suggested reaching out to the agency’s (e.g., fire department – rescues during flooding, Houston public works (wastewater), even HPD – security) to express our concerns and get support.  I did confirm no permits are needed for an owner to clear a property, especially since none had existing infrastructure.  

He recommended to give the developers and contractors some grief, so find out who is doing the work and give them hell.  James Haffelder is listed as applicant for 19142051 and Jill Schroeder for 22042858.  Who do they work for?    My GC Pal’s quote, no one wants to be the bad guy and none of the construction companies want the bad press.  

Good news is improvement 22042858 failed 150- Fire Marshall and 220 Public works and engineering (like wastewater). 

Normally permitting can take 6-9 months for a project of this size, but since this has Turner’s support it might be able to move faster.  Bottom line: we should get in front of these agencies.  Some have allegiance to Mayor’s office, others do not.

James Rains from Mary Nan’s office sent me “Project Numbers” for the Kickerillo property.  I will forward separately his email.  I was able to search for them at the link below. The project numbers are 19142051 (site work and utilities) and 22042858 (new apartments).

and select BUSINESS at the top. It will give a drop down list. Select PERMITS / BUILDING CODES. Look under PROJECT STATUS and select Check Plan Review Status. Enter project number it will show the Plan Review information. You can also see a link under the status table for a more detailed time-line. 

On the same page mentioned above you can select SOLD PERMITS SEARCH for the last three years. It provides additional information but the PERMIT TYPE codes are not defined. 

After checking both projects the work currently being done has been approved. The apartment construction is still under review. It seems all the processes are being followed and I assume the corresponding permits are too. However, I can’t find proof.

I have heard rumors that there may be some permits that don’t show up on the building permit report.  Perhaps site clearing falls within that category.  If they are building without a permit, then the City can shut them down.
